1. General

(a) The use of this website is subject to the following terms of use and is subject to change without notice.

(b) This website contains material which is owned by, or licensed to Exclusive Cars Northants Limited. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited except in accordance with the copyright notice, which forms part of these terms and conditions.

(c) All trademarks reproduced in this website, which are not the property of, or licensed to the operator, are acknowledged on the website.

(d) Users shall not create a link to this website from another website or document without Exclusive Cars Northants Limited’s prior written consent.

(e) The use of this website and any dispute arising out of such use of the website is subject to the laws of England, Scotland and Wales.

(f) Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.

1.1 Within these Terms and Conditions, the service provider is Exclusive Cars Northants Limited, also known as Exclusive Cars.

1.2 The terms “our,” “us” and “we” refer to Exclusive Cars Northants Limited hereafter.

1.3 The term “you” refers to any person(s) or company who requests, books and uses our services.

1.4 The terms “customer,” “user” and “client” is a person who either requests a service from Exclusive Cars Northants Limited or accepts any offer of services from Exclusive Cars Northants Limited.

1.5 The terms “passenger” or “passengers” refer to the person or a group of people travelling in a vehicle owned by Exclusive Cars Northants Limited.

1.6 The terms “service,” “transfer” and “journey” refer to the transportation or vehicle hire services provided by Exclusive Cars Northants Limited.

1.7 The term “booking” refers to the request from customers, users and clients who wish to use our services.

1.8 The terms “pick-up address” and “collection address” refer to the address or location stated by the customer/passenger at the time of making the booking as the address from which the vehicle shall collect the customer/passenger.

1.9 The term “drop-off address” refers to the address or destination stated by the customer/passenger at the time of making the booking as the address at which the vehicle shall drop off the customer/passenger.

2. Bookings

2.1 All bookings must be requested and pre-booked by either e-mail, telephone or via the company website. Any direct bookings attempted with our drivers will be deemed invalid.

2.2 Requests and enquiries for urgent bookings with less than 24 hours’ notice must be made by telephone by contacting +44 (0) 1536 746060 or +44 (0) 7771 544687. All website booking requests require a minimum of 24 hours’ notice.

2.3 For outbound transfers, booking requests and enquiries must include the full name(s) of the passenger(s), a contact telephone/mobile number(s) for each passenger, the full pick-up/collection address for each passenger, the date and time of the pick-up/collection for each passenger, the airline and flight number, airport and/or terminal and the flight departure time. The responsibility for providing accurate and complete information lies solely with the passenger(s).

Passengers must also declare the number of pieces of luggage and approximate sizes at the time of requesting a booking to ensure this can be carried and stowed safely according to the vehicle’s storage capacity. If it is not possible to carry excess or oversize luggage in the allocated vehicle, alternative arrangements will need to be made in advance of the pick-up/collection.

2.4 For return transfers, booking requests and enquiries must include the full name(s) of the passenger(s), a contact telephone/mobile number(s) for each passenger, the full drop-off/destination address for each passenger, the date of arrival, the airline and flight number, airport and/or terminal and the flight arrival time. The responsibility for providing accurate and complete information lies solely with the passenger(s).

Passengers must also declare the number of pieces of luggage and approximate sizes at the time of requesting a booking to ensure this can be carried and stowed safely according to the vehicle’s storage capacity. If it is not possible to carry excess or oversize luggage in the allocated vehicle, alternative arrangements will need to be made in advance of the pick-up/collection.

2.5 A formal quotation will be issued in writing upon receipt of the booking request, based on the mileage from the pick-up/collection address to the drop-off address/destination. Any surcharges, such as waiting time, car parking charges, toll road charges and congestion charges (TFL) will not be included in the quotation at this stage.

2.6 All quotations are issued in GBP Sterling and are exclusive of VAT which will be charged for all services, where applicable, at the prevailing rate.

2.7 All quotations are valid for a period of 30 days from the date of issue unless otherwise specified or agreed in writing.

2.8 Any changes to an existing and confirmed booking must be requested in writing by either the named passenger(s); or the person(s) who requested and confirmed the original booking; and agreed by Exclusive Cars Northants Limited. Any third-party changes; either verbal or written will be deemed invalid. Whilst every effort will be made to re-book the transfer, this cannot be guaranteed and will be subject to availability. Additional charges may apply to re-accommodate the transfer and a revised quotation will be issued to reflect the changes.

2.9 Exclusive Cars Northants Limited will endeavour to accommodate a passenger’s requirements for the booking of a particular vehicle and/or driver. It reserves the right, however, to supply an alternative vehicle or driver where the original request cannot be fulfilled due to circumstances beyond its control.

2.10 Should Exclusive Cars Northants Limited be unable to supply one of its own vehicles for a journey, it will supply a fully qualified sub-contractor and vehicle of equal standard. Exclusive Cars Northants Limited’s Terms and Conditions will still apply.

2.11 Exclusive Cars Northants Limited and/or its drivers (including any contracted or sub-contracted drivers) reserve the right to decline a booking if a vehicle or driver are not available for the requested dates.

3. Service Charges

3.1 Service charges will be applicable as follows:

3.2 The first 15 minutes of waiting time from the agreed pick-up/collection time is free. A waiting surcharge of £15.00 plus VAT, per hour will apply thereafter if the waiting time exceeds 15 minutes.

3.3 The first 60 minutes of waiting time from the original scheduled flight arrival time is free for airport pick-ups and excludes delayed flights and late arrivals. Car parking charges will apply.

3.4 After the first 60 minutes of waiting time from the original scheduled flight arrival time, a surcharge of £15.00 plus VAT, per hour will apply thereafter, plus car parking charges.

3.5 If a flight is delayed or arrives late, a waiting surcharge of £15.00 plus VAT, per hour will apply, plus car parking charges.

3.6 Additional charges will apply to any retrospective changes made to the original agreed booking, including any time changes, route deviations, changes to the destination and additional stops whilst en route. It may not be possible to accommodate such requests at the time of the journey, however, every effort will be made to meet the requirements.

4. Luggage

4.1 Exclusive Cars Northants Limited and/or its drivers (including any contracted or sub-contracted drivers) reserve the right to refuse a passenger or decline to undertake a journey due to a passenger carrying excess or oversize luggage, which would deem the vehicle to be unsafe for travel.

4.2 Exclusive Cars Northants Limited and/or its drivers (including any contracted or sub-contracted drivers) shall not be held responsible for any loss or damage to luggage or personal belongings left by passengers in vehicles. Passengers must ensure that all luggage and personal belongings are removed from the vehicle when exiting the vehicle.

4.3 Exclusive Cars Northants Limited and/or its drivers (including any contracted or sub-contracted drivers) will not carry any of the items listed below in its vehicles:

4.3.1 Hazardous or illegal substances and narcotics.

4.3.2 Explosives, firearms, knives, weapons, flammable products, tear gas, mace or pepper spray.

4.3.3 Pets and animals (with the exception of registered guide dogs for the visually impaired).

4.3.4 Large quantities of cash.

4.3.5 Alcoholic beverages.

4.3.6 Exclusive Cars Northants Limited reserves the right to disallow any other additional items at its discretion.

4.4 Should Exclusive Cars Northants Limited and/or its drivers (including any contracted or sub-contracted drivers) refuse to provide the service to a passenger due to the passenger carrying any items listed in clauses 4.3.1 to 4.3.6 resulting in the termination of the service, the full cost of the booking will be chargeable to the passenger(s).

5. Passenger Etiquette and Behaviour

5.1 Seatbelts must be worn by all passengers for the duration of the journey when seated in the front or rear of the vehicle.

5.2 Exclusive Cars Northants Limited operates a strict ‘non-smoking’ policy in all its vehicles in accordance with UK legislation.

5.3 Food and drink, including alcohol are not permitted to be consumed in the vehicle except water, unless prior consent has been granted by Exclusive Cars Northants Limited.

5.4 If a passenger causes any spillages, soiling, internal or external damage to the vehicle, Exclusive Cars Northants Limited reserves the right to charge cleaning, valet and repair costs to the passenger or company.

5.5 Exclusive Cars Northants Limited reserves the right to refuse a passenger entry to its vehicle who is thought to be under the influence of alcohol or drugs; or whose behaviour poses a threat to the safety of the driver, the vehicle, or other passengers in the vehicle. Under such circumstances, the full cost of the booking will be chargeable to the passenger(s).

5.6 Exclusive Cars Northants Limited further reserves the right to either refuse or terminate a journey at any time due to unreasonable or inappropriate behaviour by passengers. Passengers will be requested to vacate the vehicle as soon as it is safe to do so. Under such circumstances, the full cost of the booking will be chargeable to the passenger(s).

5.7 With reference to clauses 5.1 to 5.6 above, Exclusive Cars Northants Limited shall not be held liable or responsible for any losses, costs or damages arising from poor passenger etiquette and unacceptable behaviour.

6. Cancellation Policy and Charges

6.1 All cancellations must be submitted in writing by either the named passenger(s) or the person(s) who requested and confirmed the original booking. Any third-party cancellations; either verbal or written will be deemed invalid.

6.2 If a booking is cancelled with less than 24 hours’ notice from the agreed pick-up time, a cancellation charge for the full cost of the booking, plus VAT will apply.

6.3 If a booking is cancelled with 48 hours’ notice from the agreed pick-up time, a cancellation charge of 50% of the full cost of the booking, plus VAT will apply.

6.4 If a confirmed booking is either amended or cancelled due to flight changes, delays and cancellations; or due to a failure of services by other means of public transportation (rail, bus, taxi, boat or underground), Exclusive Cars Northants Limited will not be held responsible, or suffer any financial losses directly related to the original agreed booking. In such cases, the Cancellation Policy and Charges (clauses 6.1 to 6.6) and Liability and Indemnification (clauses 7.1 to 7.1.14) sections shall apply accordingly.

6.5 If incorrect dates and/or times, flight or airport/terminal details for either pick-up/collection or drop-off are provided by passengers in error, either additional charges, or a cancellation charge for the full cost of the booking, plus VAT will apply, plus the cost for a new booking. The responsibility for providing accurate and complete information lies solely with the passenger(s).

6.6 If a passenger fails to appear for a pre-booked and agreed pick-up/collection, the full cost of the booking, plus VAT will apply.

7. Liability and Indemnification

7.1 Exclusive Cars Northants Limited and/or its drivers, shall not be held liable or responsible for any direct, indirect or consequential loss of business or profits due to any unforeseen circumstances beyond their control. Such circumstances include, but are not limited to:

7.1.1 Extreme and adverse weather conditions.

7.1.2 Traffic, accidents and delays.

7.1.3 Road closures.

7.1.4 Flight delays, changes and cancellations.

7.1.5 Delays, changes, cancellation and failure of other means of transportation services (rail, bus, taxi, boat or underground).

7.1.6 Natural disasters.

7.1.7 Force majeure.

7.1.8 Declared national emergencies.

7.1.9 War, civil disturbances and conflicts.

7.1.10 Terrorist attacks.

7.1.11 Strikes and industrial action.

7.1.12 Acts and regulations introduced by the governmental authority (or the de facto equivalent).

7.1.13 Power failure and systems breakdown.

7.1.14 Fuel shortage.

8. Payment

8.1 Where Exclusive Cars Northants Limited has agreed to supply services on credit terms, the payment terms are 14 days from the date of invoice, unless otherwise specified. This is subject to agreement when applying for account and credit facilities.

8.2 Where Exclusive Cars Northants Limited has agreed to supply services on non-credit terms, the payment terms are immediate and upon completion of a service. An advance payment of part of the total cost of a service may be requested for non-credit account holders as a reservation fee, with the remaining balance payable upon completion of a service.

8.3 Where unforeseen costs arise as a result of provision of the services, Exclusive Cars Northants Limited shall inform the client immediately, however, reserves the right to charge additional costs to cover the said costs and expenses.

8.4 Payment via BACS, bank transfer and all major credit and debit cards are accepted.

9. Best Practice

9.1 Exclusive Cars Northants Limited strives to provide the highest standards of safety and service. Each vehicle is maintained in strict accordance with the Local Authority Carriage Office regulations and manufacturer’s recommendations.

10. Complaints

10.1 All complaints must be raised in writing with the Company Director and submitted within 7 days of the service being undertaken to enable a thorough investigation to follow suit.

11. Changes to the Terms and Conditions

11.1 Exclusive Cars Northants Limited reserves the right to amend its Terms and Conditions at any time without prior notice. Please refer to these at the time of requesting a booking, as the Terms and Conditions of service may change.
